交通违法“买分 卖分”行为刑事处罚研究

（公安部道路交通安全研究中心，北京100062，中国）摘 要：近年来，交通违法“买分卖分”现象日益猖獗，部分地方“买分卖分”非法中介丛生，甚至形成了 黑色产业链，严
重扰乱了道路交通管理秩序，损害了公安交管部门的执法公信力，更为道路交通安全埋下 巨大隐患。我国现行刑法典并未
对交通违法“买分卖分”行为及其处罚作出明确规定。从司法实践来看， 根据行为人及其行为方式不同，可以适用《刑法》
关于妨害社会管理秩序犯罪和贪污贿赂犯罪的有关规定 对该类行为进行刑事处罚。

Research on the criminal penalty of traffic illegal behavior about
the points trading

Abstract:
In recent years, the phenomenon of traffic illegal about the point trading has become increasingly serious. In some
places, there are numerous illegal agencies, and even a black industry chain has formed, which seriously disturbing the order
of road traffic management, impairing the credibility of law enforcement of public traffic administration organs, and burying
huge hidden dangers in road traffic safety. The point trading and its punishment are not clearly defined in China's current penal
code. Judging from the judicial practice, such acts may be punished by the provisions of the criminal law concerning the crimes
of obstructing the administration of public order and the crimes of corruption and bribery according to the the actor and his
behavior.

自《中华人民共和国机动车驾驶证管理办法》
（公安部令第28号）首次规定“对持证人 发生交
通事故或违章的，实行记分管理”以来，交通违
法累积记分制度对增强机动车驾驶人安全 文明意
识、减少机动车交通违法、预防道路交通事故始
终发挥了积极作用，但同时也暴露出一些 不容忽
视的问题。近年来，交通违法“买分卖分”现象
日益猖獗，部分行为人内外勾结，大肆违 法销分
牟利，甚至形成了“买分卖分”的产业链条，严
重扰乱了道路交通管理秩序，更为道路交 通安全
埋下巨大隐患。实践中，交通违法“买分卖分”
案件形态多样，根据行为人及其行为方式 不同，
