Territorial applicability
ATP is an Agreement between States, and there is no overall enforcing authority. In practice, highway checks are carried out by Contracting Parties, and non-compliance may then result in legal action by national authorities against offenders in accordance with their domestic legislation. ATP itself does not prescribe any penalties.
At the time of publishing (2003) those Contracting Parties are:tt

This information, updated on a continuous basis, concerns:

The agreement clearly states which provisions, relating for checking of insulated, refrigerated, mechanical refrigerated or heated equipment to be taken, as well as which methods and procedures for measurings and checking of insulating capacity and the efficiency of the cooling or heating appliances of special equipment for the carriage of perishable foodstuff are to be followed.
The issuance of an ATP certifcate for insulated/refirgerated equipment at least, can be given only on basis of checks and measurements carried out by an ATP-test station designated or approved by the competent authority of the country in which the equipment is registered or recorded, or of a test station designated or approved by the competent authority of the country in which the equipment was manufactured. That means that countries only are allowed to issue ATP certificates if they have signed the ATP Agreement, up to now the China didn’t.
So for your own reliability and practice Yangzhou Tonglee Reefer Container Co. may carry out measurements acc. to
the ATP requirements, which may be witnessed by the inspection of Germanischer Lloyd too, but for the issuance of an ATP certificates the equipment has to be checked and measured in an recognized ATP test station of a contacting country at least.
