根据中华人民共和国有关法律、法规和北京市有关规定，甲、乙双
方遵循自愿、公平和诚实信用的原则，共同委托丙方代理并见证甲
乙双方之间的买卖行为，经甲、乙、 丙三方协商一致，共同订立本
合同，以兹各方共同遵守。

第一条 房产成交

甲方自愿将自有的房屋产权有偿转让给乙方。该房产符合北京市建

一、成交价格

甲、乙双方经协商一致，同意上述房产成交价格为人民币元；即人

甲乙双方经协商一致，甲方认可乙方采取以下第种方式付款： 1、

世纪不动产北京区域分部另行签订交易资 金监管委托协议； c)

剩余款项的支付：

同时，甲、乙双方在此郑 重确认：前述由21世纪不动产北京区域分
部进行的资金监管款项，一经进入资金监管账户即视同乙方已 履行
向甲方给付定金和房款的义务。 2、银行贷款

（1）乙方应在签订本合同当日，预先支付总房款的 %，即人民币
元， （大写） 佰 拾 万 仟 佰 拾 元整，作为保证双方履行合同的定
金；

（2）乙方应在签订本合同 日内，另行支付人民币 元整（大写）
佰 拾 万 仟 佰 拾元整，连同先前支付的 定金（定金折抵首付款），
一并作为首付款（首付款金额按照贷款银行的贷款条件不得低于房

上述（1）、（2）款项经甲乙双方协商一致，决定采用下列第 种方

暂时存入21世纪不动产北京区域 分部在特定银行开立的监管账户内，
由该银行监管该部分资金，待该房屋权属过户手 续办理完毕及物业
交割后，连同剩余房款一并支付给甲方。此业务须由甲乙双方与21
世纪不动产北京区域分部另 行签订交易资金监管委托协议； c)

同时，甲、乙双方在此郑重确认：前述由21世纪 不动产北京区域
分部进行的资金监管款项，一经进入资金监管账户即视同乙方已履
行向甲方给付 定金和首付房款的义务。

乙方采用银行贷款的方式支付剩余房款，由21世纪不动产北京区 域
分部提供统一的金融按揭服务，乙方须与21世纪不动产北京区域分
部另行订立贷款委托协议 。

1） 经办理贷款的银行审批，乙方符合贷款条件的，贷款银行依据
乙方签署的 《委托付款授权书》将款项一次性划至甲方

在同行开设的专用结算帐户。

2） 经办理贷款的银行审批，乙方因自身原因尚不符合贷款条件的，
双方经协商，选择

a. 自银行做出不予批贷的决定起日内，乙方自行筹集剩余房款，按
照现金支付的形式支付给甲方，乙 方承担

在此期间发生的各项费用；

b. 乙方独立或转托他人申请其 他银行贷款，取得银行贷款后将款项
支付给甲方，在此期间发生的各项费用由乙方承

担；

第二条 成交价格及付款方式

c. 终止本协议的履行，由甲乙双方返还相应款项，期间发生的各项
费用由乙方承担。 三、关于税费相关规定

1、本合同履行期间内，甲、乙双方自行按国家及地方相关规定自行
缴纳各项税、费，丙方协助甲乙双方进行相关税费的确认及计算工
作。税费分担经甲乙双方协商 ，决定按照如下方式进行分担：

保证交易后买方无须负责，

否则卖方应赔偿买方由此引起的一切损失。

8、经纪代卖方所收之临时定金，由卖方收妥及签署本合约作实，如
卖方拒绝收取该临时定

金及签署本合约，则该笔定金在没有任何补偿情况下原银交回买方，
买方将不得要求任何赔

偿。

the initial deposit paid by the purchaser shall be confirmed
after the vendor accepting the said

deposit and sign this agreement. if the vendor refuse to
accept the sail deposit and sign the

agreement，the said deposit will be refunded to the purchaser
without any compensation and the

purchaser shall not claim for any compensation.

9、如买方未能履行本合约之条款以至本合约不能顺利完成，则已
付之定金将由卖方没收，

而卖方有权再将该物业售予任何人，唯卖方不可再为此而向买方进
一步追究责任或要求赔偿

损失。

provided that the purchaser fails to perform any terms of this
agreement and therefore this

agreement cannot be executed properly，the paid deposit by
the purchaser can be forfeited by the

vendor and the vendor shall have the right to resell the
property to other parties. but the vendor

shall not run further obligation or claim for compensan on to

10、卖方在收取定金后不依合约条款将该物业售予买方，则卖方除
须退还所有买方已付定金

外，并须以同等数目之金额赔偿买方以弥补买方之损失，唯买方不
可要求进一步赔偿或逼使

if the vendor fails to sell the property to the pruchaser after
